Intellectual Property in Advertising: the Problems of Using and Protection
The readers are offered the most topical issues of using and protection of intellectual property in advertising, the problems of unfair competition in the market of advertising services. The author mentions the problems of the rights on created advertising products resulted from creative activity, the problems of illegal use of someone else’s intellectual property in advertising, including unauthorized use, the unauthorized processing of products, illegal use of a trademark and others. The author analyses legal regulation of the «service-related work», the issues involved in the transition of the exclusive right to use the work embodied in the advertisement to the client (advertiser) in the process of concluding a Treaty on the production of the advertisement. The numerous examples of violations of intellectual property rights in advertising indicate the need for more rigorous regulation of the using and protection of intellectual property in advertising and in connection with the changes in the Federal law «About Advertising».
