Revisiting the Typical Investigative Situations Classification in Cases over Falsification of Evidence and Results of Operational Investigations Formed at the Initial Investigation Stage
Crimes of falsifying criminal evidence and results of investigative activity (Art. 303 of the RF Criminal Code) belong to official crimes and are very specific in their nature, due to the particular features of the subject of crime, as well as due to the peculiarities of the sphere of activities where the crime is committed. The question of the classification of investigative situations formed at the initial stage is worth considering. The authors examine the grounds for pointing out such situations. The study of the issue makes it possible to reveal common patterns of perpetration of crimes of the concerned group and to develop a model plan of investigator’s actions in one or another investigative situation in cases of the concerned category. Besides, the fact of the special legal status of the subject can affect investigative situations, that is why it is necessary to take this fact into account during the investigation of false evidence cases and consider it with respect to typical investigative situations. The development of investigative situations formed at the initial stage of making decision on the initiation of criminal cases of this category is far from being comprehensive and requires further examination.
