Article 282 of the Criminal Code (Place in the System of Extremist Crimes)
The article is devoted to questions of responsibility for the crimes of an extremist orientation, in particular, to the problems of qualification and classification of such crimes under the Russian Criminal Law. The authors attempt to analyze some of the provisions of the Resolution of Plenum of the Supreme Court of the Russian Federation of June 28, 2011 № 11 “On judicial practice in criminal cases about extremist crimes” and their possible use in judiciary practice. The authors propose a four-stage classification of this group of offences, taking into account their importance, hierarchy, and interaction, and on this basis, recommend to qualify specific criminal incidents, in particular, Article 282 of the Criminal Code of the Russian Federation “Incitement of hatred or hostility, and humiliation of human dignity” and Article 280 of the Criminal Code “Public calls to extremist activities”, distinguish between these crimes and establish the presence or absence of conjunction between the crimes of this group.
