Accounting of Personality Traits of Juvenile Defendants in the Process of Questioning at the Preliminary Investigation
The article deals with current issues of improvement of juvenile interrogation tactics during the preliminary investigation. Analysis is made of personal traits of the above-mentioned participants in criminal proceedings in relation to the basic tactical problems solved on the individual stages of the interrogation. The author considers the possible use of the interrogation tactics, called in the literature “tactical tricks”, taking into account the personality characteristics of juveniles. The personal traits of the accused juvenile during the most common investigative procedure — questioning at the preliminary investigation — is considered from the point of forensic structuring the various stages of the interrogation. This perspective makes it possible to investigate the interrogation situations, to establish their role in all the circumstances in the course of the preliminary investigation. The stages of interrogation of accused juveniles (introductory, free story and others), their relation with personality characteristics and qualities of juvenile defendants are investigated. Emphasis is placed on tactics which involves asking questions to make the interrogated defendant say things, demonstrating the interrogator’s awareness, inciting hatred between partners in crime, the assumption of the legend and other.
