For the first time the article makes an attempt to develop an algorithm of judicial review of the evidence obtained on the basis of operational and investigative activities to use them in the verdict. The authors formulate requirements for the content of the judgment to carry out operational and investigative measures restricting the rights of citizens, show a very interesting problem of testing and assessing legitimacy of judgments during submitting criminal case on the merits; express their own opinions and conclusion, show problems of enforcement and put fair questions which require a study.
