Questions of Crimes Qualification according to the Criminal Code of the Russian Federation, Clauses 280 and 282, in Application to Judicial Religion Crimes Expertise

In modern reality the real threat of national safety in Russia is represented by strengthening of terrorism and extremism in its various forms. The main articles of law directed on suppression of extremist activity are the clauses 280 and 282 of the Criminal Code of the Russian Federation. The period of 2000th was marked by growth of criminal cases instituted under given clauses with religious or religious-political motivation as a part of a crime. Corpus delicti of extremist crimes is very difficult to prove, especially in the cases connected with religious subjects. The religious judicial examination becomes one of the main arguments in practice of proving corpus delicti of extremist crimes.
